"The Paper is Worth More Than the Steel."
You manufactured perfect steel. You packed it well. But if your Bill of Lading (B/L) has one legal flaw, the bank will refuse to pay you.
In L/C (Letter of Credit) trading, banks deal in documents, not goods. If the paper fails, the deal fails.
Today, we move beyond simple typos. We analyze the 3 Legal Traps in B/L that can bankrupt a trade.
Trap #1: The "Dirty" B/L (Claused B/L)
In L/C rules (UCP 600), you must present a "Clean On Board" B/L. This means the carrier certifies the goods are in good condition.
🚨 The Nightmare Scenario
- The Mistake: The mate notes "Rusty Edges" or "Insufficient Packing" on the receipt.
- The Result: The shipping line adds a remark on the B/L. It becomes a "Claused B/L" (Dirty B/L).
- The Impact: The bank rejects payment immediately. Your steel is floating at sea, and you have $0.
Solution: Ensure packaging is perfect so the carrier has no reason to add remarks.
Trap #2: The "Consignee" Suicide
Who owns the cargo? The Consignee box tells the story. A rookie mistake here costs you the Title (Ownership).
| Notation | Meaning & Risk |
| "To Order" | ✅ Safe. Ownership is negotiable. You hold the title until you endorse it. |
| "To [Buyer Name]" | ❌ Risky (in L/C). The buyer is named as the owner. If they don't pay, retrieving the cargo is legally difficult. |
Trap #3: The "Ghost" Weight (Customs Fraud)
This is not just a math error. It is a Legal Crime.
- Scenario: Packing List says 20,000 kg. Actual Scale Weight is 19,500 kg.
- Legal Risk: Customs views this not as a typo, but as "Smuggling" or "Tax Evasion" attempt.
- Consequence: In countries like India or Brazil, this leads to 100% Cargo Confiscation + Heavy Fines.
- Rule: Never round up numbers. The Gross Weight on the B/L must match the Packing List exactly, down to the decimal (0.01 kg).
Pro Tip: The "Draft Check" Protocol
Once the ship sails, correcting a B/L costs $100 and takes 3 days. Correcting a Draft is free.
⚠️ The Golden Rule:
Never let the forwarder issue the Original B/L without your written "Confirmation of Draft." Check every letter, every weight, and every HS Code before the vessel departs.
